A defective drug is an over-the-counter or prescription medication that is known to cause severe adverse effects and/or death to a patient.  While the Food and Drug Administration (FDA) has strict policies, guidelines and standards relating to the safety of drugs reaching the consumer market, if often takes years before a drug’s dangerous side effects are fully recognized and appreciated.

3 Categories of Drug Defects:

  1. Manufacturing Defects, meaning that the drug was manufactured improperly or has been contaminated and causes harm to the person who ingests it;
  2. Side-Effect Defects, meaning that the drug was manufactured properly, but causes side effects resulting in harm to certain persons who ingest it; and
